1. Who we are. Kollaah is operated by Plixitt Solutions Sdn Bhd (BRN: 003426311-V), a company registered in Malaysia. These Terms govern your use of the Kollaah platform by both Brands and Creators.

2. The platform. Kollaah connects Brands with Creators for paid campaign work and provides escrow, messaging, content approval, and payout infrastructure for those engagements. Kollaah is an intermediary platform, not a party to the underlying commercial agreement between a Brand and a Creator.

3. Your obligations. You must provide accurate registration information (including a valid SSM/BRN for Brands), keep your account credentials confidential, and conduct all campaign communication and payment exclusively through the platform. Circumventing the platform to transact directly defeats the escrow and dispute protections this section exists to give you, and may result in suspension.

4. Escrow and fees. Campaign funds are held in escrow and released to the Creator only once the Brand approves submitted content, or per the campaign's agreed performance terms. Kollaah charges a platform fee of 12% on standard campaign payouts and 15% on performance-based payouts, deducted before disbursement. Fees are disclosed before a campaign is funded.

5. Creator status. Creators register and operate on Kollaah as independent contractors, not as employees of Kollaah or of any Brand. Where applicable, this relationship is governed by Malaysia's Gig Workers Act 2025 (Act 872) — see the in-product explainer shown during creator registration for what that means in practice.

6. Disputes. If a Brand and Creator disagree about delivered content or payment, either party may open a dispute through the platform. Kollaah reviews the campaign record (briefs, submissions, messages) and makes a binding determination on the disputed escrow funds. We aim to resolve disputes within 7 business days of opening.

7. Termination. You may close your account at any time; campaigns with funds already in escrow must be resolved (completed, refunded, or disputed) first. Kollaah may suspend or terminate accounts that violate these Terms, attempt to bypass escrow, or provide fraudulent registration information.

8. Governing law. These Terms are governed by the laws of Malaysia. Any dispute not resolved through the platform's internal process is subject to the exclusive jurisdiction of the Malaysian courts.

9. Changes. We may update these Terms as the platform evolves. Material changes will be notified in-app before they take effect.

1. What we collect. Account details (name, email, WhatsApp number), company/SSM registration details for Brands, social platform handles and verified follower statistics for Creators, campaign briefs and submitted content, messages exchanged on the platform, and payment/payout records. We do not collect more than is needed to operate the platform.

2. How we use it. To operate your account, match Brands with Creators, process escrow and payouts (via Stripe), verify social statistics, send transactional notifications, and investigate disputes or suspected abuse.

3. Who we share it with. Stripe (payment processing), reCAPTCHA/Google (bot protection), and, only as required to operate a campaign, the counterparties to that specific campaign (e.g. a Brand sees the Creator profile and content they're paying for). We do not sell personal data to third parties.

4. Retention. We retain account and transaction data for as long as your account is active, and for a reasonable period afterward to meet legal, accounting, and dispute-resolution obligations.

5. Your rights under PDPA 2010. Under Malaysia's Personal Data Protection Act 2010, you may request access to, correction of, or deletion of your personal data, and may withdraw consent to non-essential processing. Contact us at privacy@kollaah.my to make a request.

6. Security. Passwords are stored hashed, never in plain text. All data in transit is encrypted via HTTPS. Access to platform admin tools is restricted to authorised Kollaah staff and protected by two-factor authentication.
